Terms and Conditions

This is a translation for convenience. The Polish version is legally binding.

The terms and conditions of the Sushi Home & Pizza online shop apply from 08.10.2026.

§ 1. Seller and general provisions

  1. The online shop available at sushihome-gdansk.com (the “Website”) is operated by [uzupełnij w CRM], [uzupełnij w CRM], NIP (tax ID) [uzupełnij w CRM], REGON (business ID) [uzupełnij w CRM], [uzupełnij w CRM] (the “Seller”).
  2. Contact with the Seller: phone +48 722 722 879, e-mail [uzupełnij w CRM], restaurant: ul. Powstania Listopadowego 2a, 80-288 Gdańsk.
  3. These Terms set out the rules for using the Website, placing orders for meals and drinks for delivery or pickup, payments, complaints and the SUSHIPOINTS programme. The Terms are made available free of charge before the contract is concluded, in a way that allows them to be downloaded, saved and printed.
  4. Definitions: “Customer” — a natural person, legal person or organisational unit placing an order; “Consumer” — a Customer who is a natural person performing a transaction not directly related to their business or professional activity; the provisions concerning Consumers also apply to a natural person concluding a contract directly related to their business activity where the contract is not of a professional nature for them (Art. 38a of the ustawa o prawach konsumenta (Consumer Rights Act)); “Order” — the Customer’s declaration of intent aimed at concluding a sales contract; “Account” — the Customer’s individual panel on the Website.

§ 2. Technical requirements and electronic services

  1. To use the Website you need: a device with internet access, an up-to-date browser with JavaScript enabled and — for an Account — a mobile phone to receive SMS codes.
  2. The Seller provides the following electronic services free of charge: the order form (contract concluded for the time of placing the order), the Account (for an indefinite period) and — only with separate consent — marketing information by SMS or e-mail.
  3. The Customer may at any time cancel the Account (the “Delete account” button in the Account tab or a message to the Seller) and unsubscribe from marketing information (link in the message, Account settings or contact with the Seller).
  4. The Customer must not provide unlawful content.
  5. Using the Website involves the typical risks of the internet (e.g. malware, phishing). The Seller never asks for your bank password or an SMS code outside the login form on the Website.

§ 3. Placing orders and concluding the contract

  1. Orders can be placed via the Website during the order hours shown on the Website, for the earliest possible time or for a selected time.
  2. Prices on the Website are gross prices in Polish zloty and include VAT. The delivery cost, minimum order value and total amount payable are shown before the order is placed. The delivery cost depends on the address (zone or distance); the rules are described on the “Delivery and prices” page. Surcharges may be added to the delivery cost (e.g. during peak hours, in bad weather or for a longer route) — their amount is shown on that page and in the basket before the order is placed. If the amount changes before the order is sent, the Website will show the new amount for re-confirmation.
  3. The Customer selects products and extras, the pickup or delivery method, time and payment method, provides contact details and address, accepts the Terms and confirms the order with a button indicating the obligation to pay.
  4. The sales contract is concluded when the Seller confirms acceptance of the order (status “accepted” on the order page). For online payment, the order is accepted only once payment has been successfully made. After you place an order, we send a confirmation by SMS and — if you provide an e-mail address — also by e-mail, with the order details and a link to the Terms.
  5. The Seller may refuse to accept an order, in particular when it cannot be fulfilled (e.g. product unavailable, address outside the delivery area, force majeure). Any payments received are refunded without delay.
  6. The delivery time given is an estimate. We will inform you of any significant delay by phone or SMS.

§ 4. Payments

  1. The available payment methods are shown in the order form: cash or card on delivery/pickup and — if enabled — online payments (BLIK, card, e-wallets) handled by the payment operator: PayPro S.A. (Przelewy24), ul. Pastelowa 8, 60-198 Poznań, KRS 0000347935.
  2. For online payment, the order must be paid immediately after it is placed; failure to pay results in cancellation of the order.
  3. Refunds are made without delay, no later than within 14 days, using the same payment method the Customer used, unless the Customer agrees to another method that involves no costs.
  4. The Customer may voluntarily add a tip for the courier, if this option is available.

§ 5. Delivery and pickup

  1. Delivery is made within the area shown on the “Delivery and prices” page, to the address given in the order. The Customer should be available at the given address and phone number.
  2. Pickup is possible at the restaurant: ul. Powstania Listopadowego 2a, 80-288 Gdańsk, during the hours shown on the Website.
  3. The Seller may refuse to hand over alcoholic beverages to a minor or an intoxicated person (if such products are offered).

§ 6. Right of withdrawal

  1. Pursuant to Art. 38(1)(3) and (4) of the ustawa z dnia 30 maja 2014 r. o prawach konsumenta (Consumer Rights Act of 30 May 2014), the Consumer has no right to withdraw from a contract for meals prepared to the Customer’s specification or for goods that perish quickly or have a short shelf life.
  2. The Customer may cancel the order free of charge by phone as long as the Seller has not started preparing it.

§ 7. Complaints

  1. The Seller is liable to the Consumer for the conformity of the product with the contract under Art. 43a–43q of the Consumer Rights Act, and to other Customers under the Kodeks cywilny (Civil Code).
  2. Complaints can be made by phone (+48 722 722 879), by e-mail ([uzupełnij w CRM]) or at the restaurant. Given the nature of the products, please report any issue immediately after receipt, with the order number, a description of the problem and — if possible — a photo.
  3. If the product does not conform to the contract, the Consumer may request a replacement, and where this is impossible or unjustified — a price reduction or withdrawal from the contract and a refund.
  4. The Seller responds to a complaint within 14 days of receiving it. Complaints about the operation of the Website or Account are handled within the same time limit.

§ 8. SUSHIPOINTS programme

  1. Every Customer placing orders with a phone number takes part in the programme; logging in to the Account is required to use points.
  2. For each completed order we award points worth 2% of the amount paid for products (excluding delivery costs and tips). Points are assigned to the phone number after the order is completed. The value of a point at payment is shown in the basket and in the Account.
  3. New Customers may receive welcome points (50 pkt = 50 zł), and Customers who have provided their date of birth — birthday points (100 pkt = 100 zł), if the Seller runs such promotions.
  4. Points can be used as a discount on subsequent orders. Points cannot be exchanged for cash or transferred to another person.
  5. If an order is cancelled, the points used for it are returned to the Customer’s account.
  6. The Seller may change the programme rules or end it, announcing this on the Website at least 30 days in advance; points collected can be used until the programme ends.

§ 9. Promotions, discount codes and prices

  1. The rules of individual promotions and discount codes are given in their descriptions on the Website. Promotions cannot be combined unless the description states otherwise.
  2. Whenever we announce a price reduction for a product, we also show the lowest price of that product in the 30 days before the reduction.

§ 10. Reviews

Reviews shown on the Website come from the Seller’s public Google business profile and are selected by the Seller. The Seller does not verify whether their authors ordered products via the Website.

§ 11. Out-of-court dispute resolution

The Consumer may use the free assistance of a municipal or district consumer ombudsman (rzecznik konsumentów) and may apply to the Wojewódzki Inspektor Inspekcji Handlowej w Gdańsku (Provincial Inspector of Trade Inspection in Gdańsk) to initiate mediation proceedings, or to a permanent consumer arbitration court. Information: www.uokik.gov.pl.

§ 12. Personal data

The rules for processing personal data are described in the Privacy Policy and the Cookie Policy.

§ 13. Final provisions

  1. The Seller may amend the Terms for important reasons (change in legislation, change in payment or delivery methods, change in the scope of services). Amendments do not apply to orders placed before they take effect. We announce changes to the Account terms 14 days in advance.
  2. Matters not covered here are governed by Polish law, in particular the Kodeks cywilny (Civil Code), the ustawa o prawach konsumenta (Consumer Rights Act) and the ustawa o świadczeniu usług drogą elektroniczną (Act on Providing Services by Electronic Means). The provisions of these Terms do not limit the Consumer’s rights under mandatory provisions of law.
